PROHIBITION ON COMMERCIAL REDISTRIBUTION

 

The copies of records provided herein are forwarded subject to the following representations, conditions and restrictions:

 

1.                  All copies/data are provided “as is” without warranty of any kind, and the requester is responsible for understanding the accuracy limitation of all records information provided.  The County of Hunterdon makes no representations of any kind, including but not limited to warranties of merchantability or fitness for a particular use, nor are any such warranties to be implied with respect to the records information furnished. Furthermore, the County makes no representations that the records information contained herein is accurate and complete. The County of Hunterdon shall not be subject to liability for any loss of profits or consequential damages or claims against the requester by third parties.

 

2.                  The County of Hunterdon reserves a copyright for the records information provided.  The records information is provided for the personal utilization of the requester.  Under the New Jersey Constitution Article VII, Section III, Paragraph 2, the reproduction, redistribution, manipulation or sale of the records information for commercial purposes, is strictly prohibited.  The sorting, sale and distribution of the names and addresses for mailing list purposes or otherwise, or the sale or distribution of other personal identifying information such as social security numbers or driver’s license numbers is strictly prohibited.

 

3.                  The requester agrees to hold the County of Hunterdon, New Jersey, and all its employees and agents harmless from any claim, suit or proceeding arising out of the use the records information, including indemnification of the County of Hunterdon and the State of New Jersey for reasonable expenses incurred in defending such claims.    

 

4.                  Any maps, publications, reports, or other documents produced as a result of a project which utilize Hunterdon County digital data will credit the County's Geographic Information System as the source of the data with the following credit/disclaimer:

 

                                    "This (map/publication/report) was developed using Hunterdon  County, New Jersey, Geographic Information System digital data,                                                            but this secondary product has not been verified by Hunterdon County and is not county‑authorized."

 

The requester agrees to abide by the use and reproduction conditions specified above. By obtaining and/or using the records information provided herein, the requester acknowledges the terms and conditions have been read and the requester is bound by these criteria.
